1. Affidavit of service filed. Let it be taken on record. 2. Present petition has been filed with the following prayers a) A writ in the nature of Mandamus commanding the respondent authorities, particularly the Regional Transport Authority, not to grant and/or issue any fresh auto- rickshaw permits on Route No.302(Pakapool to Bhojerhat via Jirangacha Hospital and Hatisala); b) Issuing a writ of Mandamus directing the respondent authorities to take immediate and effective steps to prevent and stop illegal and unauthorised plying of auto rickshaws on the said Route No.302 without valid permits and to take appropriate action in accordance with law against such violators specifically in terms of Section 74(3)(a) of the Motor Vehicles Act, 1988; c) A writ in the nature of Mandamus commanding the respondent authority
2 particularly respondent no.2 herein to consider the representation dated 26.11.2026 made by the petitioner; d) A writ in the nature of Certiorari directing the respondents to produce the records of this case so that conscionable justice may be meted out to the petitioner; e) Rule in terms of prayer (a) and (b) above; f) Ad interim order directing the respondent authority not to grant and/or issue any fresh auto-rickshaw permit on Route No.302(Pakapool to Bhojerhat via Jirangacha Hospital and Hatisala); g) Costs incidental of this application ; and h) Such other or further order or orders as Your Lordships may deem fit and proper. 3. At the outset learned counsel for the petitioner states on instruction that he does not want to press prayer (a) and (f) and seeks permission to withdraw the same. 4. In view of the same prayer (a) & (f) is dismissed as withdrawn. 5. In respect of other prayers learned counsel for the petitioner submits that he would be satisfied if his representation dated 26th November, 2025 is consider and dispose of within a reasonable time by the Regional Transport Authority, South 24 Parganas, in accordance with law after taking into account all relevant memos and notification. 3

Learned Government Pleader has very fairly submitted that communication dated 26th November, 2025 shall be considered and dispose of in accordance with law after taking into account all relevant memos and notifications by a reason order after giving an opportunity of being heard to all the stake holders within a period of eight weeks. 7. In view of the submission made the present petition is disposed of with the direction to the respondent no.2 to dispose of the representation dated 26th November, 2025 in accordance with law after giving notice to the petitioner or his representative, all the stack holders after taking into account all relevant memos and notifications within the period of eight weeks by a reasoned order. The order shall be communicated to the petitioner within one week of passing such order. 8. In view of the discussion made hereinabove, the petition stands disposed. ( Dinesh Kumar Sharma, J. )
