02/ 14.05.2026: Heard learned counsel for the petitioner and learned counsel for the State.
2. The petitioner is apprehending his arrest in connection with Dhanbad P.S. Case No.367/2025, registered for the offence under Sections 109, 126(2), 115(2), 308(5), 351 and 352 of the BNS and Section 27 of the Arms Act, pending in the Court of the learned C.J.M., Dhanbad.
3. Learned counsel appearing for the petitioner submits that the petitioner has been falsely implicated in the case. He further submits that the allegation of firing and snatching money is there against one Shubham Yadav. He next submits that petitioner has got no criminal antecedent which is disclosed in para 21 of the petition. He next submits that co-accused has been granted anticipatory bail in A.B.A. No. 728 of 2026.
4. Learned counsel appearing for the State opposed the prayer and submits that the allegations are there of presence of the petitioner on the spot.
5. Looking into the contents of the FIR, it transpires that the allegations of snatching the money and firing are there against Shubham Yadav and that allegation is not made against the petitioner. The co-accused has been granted anticipatory bail in A.B.A. No. 728 of 2026. In the attending

facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner.

Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Dhanbad in connection with Dhanbad P.S. Case No.367/2025, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
