HIGH COURT OF JUDICATURE AT ALLAHABAD PUBLIC INTEREST LITIGATION (PIL) No. - 2221 of 2026 Court No. - 51 HON'BLE ARUN KUMAR, J.
1. Heard Sri Sanjay Pandey, learned counsel for the petitioner, learned Standing Counsel for respondent nos. 1 to 5 and Sri Pradeep Singh, learned counsel for respondent no. 6. 2. The present petition has been filed seeking a direction to the revenue authorities to repair/reconstruct the damaged interlocking road constructed over Plot No. 609M recorded as Naveen Parti in the revenue record of Village Jigna Road, Tehsil Sadar, District Mirzapur. 3. The learned counsel for the petitioner contends that the existing interlocking road was constructed from the Gaon Sabha fund, which has been removed by respondent Nos. 7, 8 & 9 and the revenue authorities are not getting the said interlocking road restored. 4. In view of the direction of this Court, instruction dated 03.10.2026 sent by the Block Development Officer, Development Block 96, District Mirzapur has been placed before the Court, which is taken on record. 5. A perusal of the aforesaid instruction shows that the chak road is recorded over Plot No. 605 adjacent to which house of respondent no. 7 exists. The petitioner has encroached upon Plot No. 609M by raising permanent construction in respect to which proceeding under section 67 of the U.P. Revenue Code, 2006 has been registered against him as Case No. T202516530107896. Another Case No. T202516530107889 has been registered under section 67 of the U.P. Revenue Code, 2006 against respondent no. 7. Both the cases are pending before the Tehsildar, Tehsil Sadar, District Mirzapur. Versus Counsel for Petitioner(s) : Rajesh Sharma, Sanjay Pandey Counsel for Respondent(s) : C.S.C., Pradeep Singh Rajendra Singh .....Petitioner(s) State Of U.P. And 8 Others .....Respondent(s)
6. It is further contended that the interlocking road over Plot No. 609M area 0.019 hectare gives access only to the houses of respondent nos. 7, 8 & 9, who have some dispute with the petitioner regarding encroachment over Plot No. 609M. Therefore, the present petition is more for redressal of the private dispute than having any element of public interest in it. It has been further stated that the respondent nos. 7, 8 & 9 on being directed, have restored the bricks over the pathway in question. 7.
It is evident that in respect of Plot No. 609M, the petitioner has himself encroached upon the said land against which appropriate proceedings are pending. Proceedings under section 67 of the U.P. Revenue Code, 2006 also been registered against respondent no. 7. 8. In view of the aforesaid facts, as appropriate action under the relevant provisions of law have already been initiated against the encroachers for Plot No. 609M, no further inquiry is required to be conducted by this Court in the present PIL. 9. The present petition is disposed of with direction to the Tehsildar, Tehsil Sadar, District Mirzapur to decide the Case Nos. T202516530107896 and T202516530107889 pending before him, in accordance with law, after hearing the concerned parties within a period of three months from the date of production of certified copy of this order and ensure that the proceedings initiated under section 67 of the U.P. Revenue Code, 2006 against the encroachers are brought to its logical end. October 5, 2026 Sartaj WPIL No. 2221 of 2026 2 (Arun Kumar,J.)
