Heard Mr.Pushpendra Singh Baghel, learned counsel for the petitioner as well as Mr.Ashish Shukla, learned Additional Advocate General appearing for the respondent/State. 2. The present petition has been filed by the petitioner seeking BABLU RAJENDRA BHANARKAR Digitally signed by BABLU RAJENDRA BHANARKAR Date: 2026.05.07 14:26:08 +0530 2 following relief(s): “i) Quash and set aside the impugned FIR No. 315/15 dated 08.08.2015 registered at Police Station Kotwali, Korba, District Korba. ii) Quash the charge-sheet No. 10/2016 dated 05.01.2016, and all consequential criminal proceedings arising therefrom against the Petitioner in Criminal case No. 177 of 2016, pending before the learned Judicial Magistrate First Class, Korba; iii) Quash the order(s) of cognizance dated 19.01.2016 (and other similar orders, if any) passed by the learned Trial Court in the aforesaid cases; iv) Pass such order, as it deems fit, in the circumstances of the case.” 3. Learned counsel for the petitioner submits that, though the case pertains to the year 2016, out of 33 prosecution witnesses, only 22 have been examined so far. The remaining prosecution witnesses, who are police personnel, are not appearing before the Trial Court. Consequently, the trial has been prolonged for several years, causing hardship to the petitioner. It is further submitted that the petitioner is entitled to a speedy trial and, therefore, has approached this Court seeking quashing of the criminal proceedings. 4. From a perusal of the charge-sheet and other documents, it transpires that the trial is in progress and that out of 33 prosecution witnesses, 22 have already been examined. The 3 remaining witnesses, who are mainly police personnel, are not appearing before the Trial Court, on account of which the trial has been held up. 5. Considering the aforesaid facts and circumstances, the Director General of Police, Chhattisgarh, Police Headquarters, Raipur, is directed to ensure the presence of the remaining prosecution witnesses, who are mainly police personnel, before the Trial Court on the next date fixed by the Trial Court, i.e., 08.05.2026, as reflected on the official portal of the Chief Judicial Magistrate, Korba. The Trial Court is also directed to conclude the trial as expeditiously as possible, preferably within a period of six months from today. 6. With the aforesaid observations and directions, the petition stands disposed of. 7. The Registrar (Judicial) of this Court is directed to send a copy of this order forthwith to the concerned Trial Court as well as to the Director General of Police, Chhattisgarh, Police Headquarters, Raipur.
