1. This Bail Application under Section 483 and 484 of the Bharatiya Nagarik Suraksha Sanhita, (BNSS) 2023, has been filed to release the petitioner on regular bail in connection with Balumath P.S. Case No. 94 of 2025, for the offences punishable under Sections 111(3), 111(4), 308 (4), 308(5) and 61 (2) of the B.N.S. along with Sections 25 (1-B) a /26 /35 of the Arms Act, pending before the Court of learned Chief Judicial Magistrate, Latehar.
2. Heard the learned counsel for the petitioner and learned counsel for the State. Perused the materials available on record and also gone through the impugned order.
3. Learned counsel for the State opposes the prayer of the petitioner for grant of bail.
4. The allegation against the petitioner is that one country made pistol as well as three live cartridges in its magazine and mobile phones have been recovered from the possession of the petitioner. It is submitted that the petitioner is in custody since 16.08.2025 and charge-sheet has already been filed in this case.
5. Since the materials are not sufficient to keep the petitioner in custody, thus, I am inclined to release the petitioner on bail.
6. Accordingly, this Bail Application is allowed. The petitioner above named is directed to be released on bail in connection with Balumath P.S. Case No. 94 of 2025, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand Only), with two sureties of the

like amount each to the satisfaction of the learned Chief Judicial Magistrate, Latehar, subject to the condition that one of the bailers should be a close relative of the petitioner, having sufficient landed property in his / her own name within the State of Jharkhand and also the petitioner shall appear before the Court concerned once in a month.
