Versus Counsel for Applicant(s) : Krishna Kanhaiya Soni, Mukesh Joshi Counsel for Opposite Party(s) : G.A. Samiksha Rani And Another .....Applicant(s) State of U.P. .....Opposite Party(s)
5. I have heard learned counsel for the accused-applicant and perused the record. 6. It appears from the record that the first informant, Samiksha Rani, was a major at the relevant time and was in a relationship with the accused- applicant, Ritu Raj Singh @ Ranu. It is alleged that the accused-applicant had assured her that he would solemnize marriage with her and, on the basis of such assurance, the parties continued their relationship and established physical relations with each other. Subsequently, a dispute arose between the parties, resulting in registration of the aforesaid criminal case. 7.
An FIR was registered on 20.04.2017 being Case Crime No. 262 of 2017, under Sections 376, 120-B, 504 and 506 IPC, at Police Station Thakurdwara, District Moradabad, against the accused-applicant, Ritu Raj Singh @ Ranu, and his family members, alleging sexual exploitation of the first informant on the false promise of marriage. After investigation, charge-sheet was submitted only against the accused-applicant, Ritu Raj Singh @ Ranu, for offences under Sections 376, 504 and 506 IPC. 8. After submission of the charge-sheet, a compromise was entered into between the accused-applicant, Ritu Raj Singh @ Ranu, and the first informant, Samiksha Rani. Pursuant to the said compromise, the present application under Section 482 Cr.P.C. has been filed seeking quashing of the charge-sheet. 9. From the perusal of the record, it is evident that the first informant had attained majority at the relevant time. Her medico-legal report is on record, wherein her date of birth has been recorded as 08.10.1989. A marriage certificate of Ritu Raj Singh @ Ranu and Samiksha Rani is also on record, according to which they solemnized their marriage on
07.09.2015. Thus, the first informant was a major at the relevant time. 10. It is further apparent from the record that the parties have voluntarily entered into a compromise, which has been duly verified by the trial court. As per the compromise, the first informant does not wish to pursue the matter any further. A482 No. 14734 of 2018 2
11. Considering the facts and circumstances of the case, particularly the fact that the first informant was a major at the relevant time, the parties had been in a relationship, they have subsequently solemnized their marriage, and the compromise entered into between them has been duly verified by the competent court, no useful purpose would be served by permitting the criminal proceedings to continue. 12. Accordingly, the instant application under Section 482 Cr.P.C. is allowed. Consequently, the proceedings of Case No. 281 of 2018 (State Vs.
Ritu Raj Singh @ Ranu), arising out of Case Crime No. 262 of 2017, under Sections 376, 504 and 506 IPC, Police Station Thakurdwara, District Moradabad, pending before the Court of A.C.J.M.-V, Moradabad, and all consequential and incidental proceedings arising therefrom, are hereby quashed.
