Mrs. Nirupama, learned counsel appearing for the appellant and Mr. Abhishek Kumar Dubey, learned counsel appearing for the respondent no.5 have jointly submitted that the joint affidavit is ready pertaining to the settlement of the dispute, the same has been prayed to be taken on record. 4. The copy of the same has been served upon learned State Counsel. 5. The affidavit is taken on record. 6. Both the appeals have been listed together for analogous hearing. 7. The dispute is in between two wives, arisen after death of the deceased employee namely Manbodh Singh Munda. 8. The claim of the appellant, namely, Parwati Devi is that she is the first wife. Jawoni Devi is respondent no.5 is claimed to be the second wife of late Manbodh Singh Munda. 9. Jawoni Devi has approached to this Court by filing Writ Petition being W.P.(S) No. 5834 of 2019 and a direction was passed vide order dated 10.10.2022 by the learned Single Judge of this Court containing the direction upon the respondent to act on the basis of the nomination and proceed for disbursement of death-cum-retiral benefits to the nominee at the earliest. 10. Another Writ Petition was filed by the appellant Parwati Devi being W.P.(S) No. 1605 of 2023 but the learned Single Judge has declined to pass positive direction in view of the order already passed on 10.10.2022 in W.P.(S) No. 5834 of 2019. 3

Therefore, the two appeals have been filed one against the order dated 10.10.2022 passed in W.P.(S) No. 5834 of 2019 and which is the subject matter of the Letters Patent Appeal being L.P.A. No. 376 of 2025 and another Writ Petition which was dismissed vide order dated 21.09.2023 has been challenged by the appellant in L.P.A. No. 108 of 2025, therefore, both appeals have been
directed to be heard together. 12. The matter was heard by this Court at length on various occasions. Finally, i.e. on 5th May, 2026 when the matter was being heard, learned counsel for both the parties i.e., the appellant and the respondent no.5 have jointly prayed for adjournment in the matter so that they may come with the term of settlement on the issue. The joint affidavit in pursuance to the said order has been filed on 14.05.2026. 13. Both the parties have come to the settlement as per the statement made to that effect as under Paragrpah-3 to 9, the terms and conditions as referred in Paragraph-3 to 9 are being referred herein:
“3. That both the parties have agreed that Viswanath Kok @ Viswanath Munda, son of Late Manbodh Singh Munda &Parwati Devi be appointed on compassionate grounds and for that purpose, none of the parties shall have any objection. 4. That both the parties have agreed that family pension be sanctioned in favour of the Jawoni Devi (Respondent No.5), one of widow of Late Manbodh Singh Munda. 5. That there is no dispute regarding amounts already received by the parties individually. 6. That the amount which is yet to be paid by the department has been agreed to be distributed between them in the ratio of 2:3 i.e. 40 % of the toal pending amount of retiral dues of Late Manbodh Singh Munda, be sanctioned in favour of Parwati Devi and 60% of the pending amount be sanctioned in favour of Jawoni Devi. 7. That in view of the amicable settlement arrived at between the parties, no dispute survives for adjudication before this Hon’ble Court. 4
8. That both parties are filing the present settlement agreement jointly and praying before this Hon’ble Court to kindly take the settlement-agreement on record and dispose of the present proceedings in accordance with the terms of settlement arrived by and between the parties. 9. That during the pendency of the case, with the intervention of well-wishers the parties have amicably settled and resolve all their dispute and differences out of the Court.”
14. The learned counsel appearing for both the parties have jointly submitted that since both the parties have agreed and as such in view of the terms and conditions of the agreement both the appeals may be disposed of. 15.
This Court considering the aforesaid condition, having no dispute in between the appellant and the respondent no.5, is hereby disposed of the Letters Patent Appeals with a direction to the State to carry out the terms and conditions of the agreement so that the dispute be finally come to an end. 16. Both the parties have agreed to provide compassionate appointment in favour of one Viswanath Kok @ Viswanath Munda, Son of late Manbodh Singh Munda and Parwati Devi. 17. Accordingly, the respondent-State is directed to proceed with the matter for consideration of the issue of appointment on compassionate ground to be considered by the District Compassionate Appointment Committee, Ranchi. 18. The Committee will take final decision and forward it to the concerned competent authority preferably within the period of three (03) months from the date of receipt of copy of the order. 19. So far as the issue of family pension is concerned, the respondent-State is directed to finalize the family pension in favour of the respondent no.5, i.e second wife, one of the widows of late Manbodh Singh Munda. 5
20. Both parties have agreed that whatever amount has been paid in favour of respondent no.5 shall remain undisputed, and no claim will be raised with regard thereto. 21. The amount which is yet to be disbursed by the Department has been mutually agreed by both parties to be apportioned between them in the ratio of 2:3, whereby 40% of the total pending retiral dues of late Manbodh Singh Munda, the deceased employee, shall be sanctioned in favour of Parwati Devi, the appellant herein, and the remaining 60% shall be sanctioned in favour of Jawoni Devi, respondent no.5, the second wife. 22. The respondent-State of Jharkhand is directed to carry out the said exercise, which is to be concluded within a period of three (03) months from the date of receipt of copy of the order. 23.
The parties have further agreed that in view of the aforesaid settlement, no dispute remains. 24. This Court in view of the aforesaid facts, is hereby disposing of both the appeals. 25. The Secretary, Panchayati Raj as also the Deputy Commissioner, Ranchi is to ensure compliance within the stipulated time as directed and referred hereinabove. 26. Accordingly, both the appeals stand disposed of. (Sujit Narayan Prasad, J.)
