2 Consequently, an offence was registered at Police Station Gandhi Nagar, District Surguja, against the accused persons. 3. Learned counsel for the applicant would submit that the applicant has been falsely implicated in this case. He submits that there is no direct allegation against the present applicant. He also submits that considering the material available on record, no prima facie case is made out against the present applicant. In the present case, the charge-sheet (challan) has already been filed by the prosecution and the trial is pending in Criminal Case No. 524/2026. He further submits that the co-accused, namely Anish Giri, received the money and thereby committed embezzlement. He submits that the applicant has no criminal antecedents and she is in jail since 28.11.2025, conclusion of the trial may take some time, therefore, he prays for grant of regular bail to the applicant. 4. Learned State Counsel opposes the bail application and submits that the present case pertains to an organized cyber fraud syndicate involving the routing of proceeds of crime through multiple bank accounts and withdrawal of cash by deceptive means.
It is contended that as per the case diary and statements of co-accused, clearly establishes that the present applicant, Varsha Singh Porte, knowingly provided her bank account for receiving and facilitating the transfer of fraudulent funds in furtherance of the criminal conspiracy and for monetary gain. It is further submitted that such acts demonstrate her active participation in the offence, which has serious ramifications on the financial system and public confidence. Considering the gravity of the offence, the organized nature of the crime, and the likelihood that the applicant, if released on bail, may tamper with evidence or influence witnesses, therefore, the she is not entitled for grant of regular bail in the present case. 5. I have heard learned counsel appearing for the parties and perused the
3 case diary. 6. Considering the aforesaid facts and circumstances, this Court notes that the allegations pertain to an organized cyber fraud syndicate involving the routing of proceeds of crime through multiple bank accounts and withdrawal of cash by deceptive means. Further, the material available on record, including the case diary and statements of co-accused, prima facie indicates that the present applicant, Varsha Singh Porte, knowingly provided her bank account for receiving and facilitating the transfer of fraudulent funds in furtherance of the criminal conspiracy and for monetary gain. The nature of the offence reflects a serious and organized financial crime with wider implications on the financial system and public confidence. Considering the role attributed to the applicant, the gravity of the offence, and the possibility of tampering with evidence or influencing witnesses if released on bail, this Court is not inclined to grant bail to the applicant. 7. Accordingly, the bail application of the applicant - Varsha Singh @ Varsha Singh Porte, involved in Crime No. 649/2025 registered at Police Station Gandhinagar (Ambikapur), District – Surguja (C.G.), for the offence punishable under Sections 318(4), 317(4), 61(2) and 111 of the Bhartiya Nyaya Sanhita, 2023, is rejected. 8.
Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9. OfÏce is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith. - Sd/-
