: Mr. Kaushik S. Advocate For the State
: Mr. Sardhu Mahto, Addl. P.P. ------ HON’BLE MR. JUSTICE ANIL KUMAR CHOUDHARY ------ Order No:- 02, Dated:- 12th May, 2026
Heard the parties. This is the third journey of the petitioner for grant for regular bail. Earlier, the prayer of the petitioner for grant of regular bail was rejected by this Court vide order dated 23.04.2025 and 12.12.2025 passed in B.A. No. 3211 of 2025 and 9465 of 2025 respectively. The petitioner has moved before this Court for grant of bail in connection with Pratappur P.S. Case No. 141 of 2024 registered for the offences punishable under sections 140(1), 3(5) of the B.N.S.
The learned counsel for the petitioner submits that the fresh ground of the petitioner for grant of bail is that in a meanwhile, two more witnesses have been examined including the informant wherein the informant has categorically stated that he is not the eye-witness of the occurrence and he has instituted the case only on the basis of suspicion. It is further submitted that he has also been declared hostile; as he departed from the statement made before the police. It is further submitted that the allegations against the petitioner are all false and the petitioner has no criminal antecedent as has been mentioned in paragraph no. 12 of the bail application. It is then submitted that the petitioner has been in custody since 27.12.2024, as has been mentioned in paragraph no. 13 of the bail application. Hence, it is submitted that the petitioner be admitted to bail. The learned Addl. P.P. opposes the prayer for bail. Considering the submissions of the counsels and the fact as discussed above, I am inclined to enlarge the abovenamed petitioner on bail. Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs.
25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Session Judge - III, Chatra, in connection with Pratappur P.S. Case No. 141 of 2024, with the condition that the petitioner will cooperate with the trial of the case and will furnish his mobile number and a copy of his Aadhar Card in the court below with the undertaking that he will not change his mobile number during the trial of the case, with further condition that he will not annoy or disturb the informant or the witnesses of the case in any manner during the trial of the case.
