VIBHU BAKHRU, CHIEF JUSTICE) 1. IA.No.1/2025 - This is an application seeking recall of the order dated 12.11.2025, whereby the aforementioned complaint was closed. On the said date, the complainant was not represented. - 3 - HC-KAR NC: 2026:KHC:12396-DB CCC No. 269 of 2025 2. For the reasons stated in the application, the same is allowed. In view of the above, the order is recalled. 3. The complainants have filed the present complaint alleging wilful disobedience of the order dated 28.01.2025 passed by the learned Single Judge of this Court in Writ Petition No.20015/2022 [LB-RES]. Paragraph 10 of the said Order is relevant and is set out below: As a consequence, the Gram Panchayat is directed to register the khata in favour of the petitioner, if not already registered as per the official memorandum dated 13.01.2022 within a period of two weeks from today. 4. It is the complainant's case that in terms of the memorandum dated 13.01.2022, the Gram Panchayath was required to register the khata for the entire property in favour of the complainants within a period of two weeks. 5. An affidavit of compliance has been filed by the accused, indicating that the khata has been registered in favour of the complainants to the extent of the residential property. - 4 - HC-KAR NC: 2026:KHC:12396-DB CCC No. 269 of 2025 6. According to the complainants, the order has not been complied to the full extent. The learned counsel for the accused submits that the order dated 28.01.2025 must be understood to direct registration of a khatha in respect of the residential property. He submits that after the writ petition was disposed of, the learned Single Judge kept the matter for compliance. It was listed before the Court on several occasions including on 03.03.2025, 10.03.2025 and 25.03.2025. The Order passed on 25.03.2025 reads as under: "As ordered by this Court on 28.01.2025, the Grama Panchayat has registered the Khatas in favour of the petitioners and has placed on record the certified copies of the same along with a memo. Same are taken on record. In the light of the above, no further order is necessary". 7. It is apparent from the above that the learned Single Judge also proceeded on the basis that the order dated 28.01.2025 has been complied with. 8. In view of the above, we are unable to accept that any proceedings under the Contempt of Courts Act, 1971 is required to - 5 - HC-KAR NC: 2026:KHC:12396-DB CCC No. 269 of 2025 be initiated. We however, clarify that this order will not preclude the complainants from seeking an appropriate clarification from the concerned Court or to avail of any other remedy. Needless to state that if the order dated 28.01.2025 is clarified to mean as claimed by the complainants, the complainants would also not be precluded from filing afresh, if the order as clarified is not complied with. 9.
