ORDER ON BOARD 06/02/2026
1. Petitioner has filed this writ petition seeking following reliefs.
“10.1 That, this Hon’ble Court may kindly be pleased to call for entire records which relates to proceedings o appointment of in-charge Principal in Govt. High School Lohardih. 10.2 That, this Hon’ble Court may kindly be pleased to issue an appropriate writ by quashing the impugned order dated 20.01.2026 (Annexure P-1) passed by Respondent No. 4. 10.3 That, this Hon’ble Court may kindly be pleased to issue an appropriate writ by commanding and directing the respondents authority to consider and decide the PAWAN KUMAR JHA Digitally signed by PAWAN KUMAR JHA
2 / 3 representation of petitioner within stipulated time in an objective manner. 10.4 Any other relief as this Hon’ble Court may deem fit looking to the facts and circumstances of the case may also be awarded.”

Learned counsel for petitioner submits that petitioner is holding post of Lecturer and posted at Govt. High School, Lohardih, Block Mahasamund working as incharge Principal of the said school. Petitioner thereafter came to know that in the gradation list, petitioner has not been appropriately placed and his seniority is fixed much below than for which he is entitled for based on the decision of Division Bench of this Court in WPS No. 3286 of 2021 and connected matters. He submits that representation is submitted but no decision has been taken on the representation submitted by petitioner. He however submits that only after making representation, Respondent No. 4 has issued a letter on 20.01.2026 for handing over the charge of Principal to Respondent No. 5 which is a counter blast. He however submits that as the representation submitted by petitioner is pending consideration, therefore direction be issued to Respondent No. 4 to take decision on the representation at the earliest within specified time.
3. Learned State counsel submits that in view of limited prayer made by learned counsel for petitioner, he is having no objection.

On due consideration of the submission of learned counsel for the parties and in particular considering submission of learned counsel for petitioner that petitioner is entitled for seniority at appropriate place in gradation list, in view of decision passed by Division Bench of this Court in WPS No. 3286/2021 and connected matters as also circular issued by the State Government, without entering into merits of the case, I find it appropriate to dispose of this writ petition directing Respondent No. 4 to consider and take decision on the representation of petitioner, in accordance with law, expeditiously, preferably
3 / 3 within a further period of 03 weeks from the date of receipt of copy of order passed by this Court.
5. Accordingly, this writ petition is disposed of with the aforesaid observation and direction.
