1. Heard Ms. B Hazarika, learned counsel on behalf of the petitioner. Also heard Mr. D Das, learned counsel for the Nos. 2 and 3 and Mr. P Das, learned counsel for the respondent Nos. 4 and 5. 2. The petitioner herein has an account in Axis Bank, Goalpara Branch,
Page No.# 3/5 Goalpara bearing account No. 920020062749920. The petitioner admittedly indulged in Online Trading Game, namely, Saathi Coin Game by way of its registered application. On 18.10.2025, the petitioner was rewarded an amount of Rs. 50,000/-, which was credited to the petitioners SBI bank account on
18.10.2025. On the same date, various transactions were carried out by the petitioner including the transaction of Rs. 95,000/- to his bank account maintained with the Axis Bank. On account of a complaint made by the respondent No. 6, an amount of Rs. 1,77,000/- has been kept in lien in both the accounts of the petitioner. It is under such circumstance, the petitioner has approached this court by filing the present writ petition. 3.
The record reveals that the respondent No. 5 has filed an affidavit-in- opposition, wherein it is stated that the petitioner’s bank account No. 920020062749920, maintained in the Axis Bank Limited, Goalpara Branch is under debit freeze / lien mode for total amount of Rs. 1,77,000/-. 4. The details of the transactions mentioned in the paragraph No. 5, which is reproduced hereinbelow:
“5. That with regard to the statements made in Paragraph No.6,7, and 8 of the writ petition, the deponent begs to state that a close perusal of "Annexure No.7" of the writ petition at page No.31 thereof, goes to indicate that at present the bank account No.920020062749920, of the writ petitioner at Axis Bank Ltd, at Goalpara Branch is under debit freeze/lien mode for a total amount of Rs. 1,77,700/- (Rs.One Lakh Seventy Seven Thousand Seven Hundred) only under the direction of the following Statutary Authority vide.... (i). Rs.77,000/- (Rs.Seventy Seven Thousand)only under the direction of the Office of the Station House Officer, Cyber Police Station, Sector-17, Rohini, Delhi, in OC No.8968 ARDated 18/10/2025 of Cyber police Station, Rohini, Delhi, whichwas sent through email dated 01/01/2026 by REENA, Head Constable, Rohini District, Delhi. (ii). Rs.50,000/- (Rs.Fifty Thousand)only under the di-rection of the Office of the SHO, Cyber Police Station, Rohini District, Delhi, in Complaint No/FIR

5. It is also mentioned that in view of the complaint, the respondent Axis Bank has complied with the direction of the respondent No. 6. 6. This Court finds it relevant to take note the Standard Operating Procedure (NCRP)-(CFCFRMS), Custody, Restoration of Money and Grievance Redressal dated 02.01.2026 issued by the Ministry of Home Affairs.
Section III of the said SOP provides a Grievance Redressal Mechanism and it is also seen from the perusal thereof that the said Grievance Redressal Mechanism provides an adequate and efficacies relief. 7. Considering the above, this Court is of the opinion that the petitioner will be well advised to approach the Branch Manager of the Axis Bank wherein the petitioner’s bank accounts have been kept on lien for an amount of Rs. 1,77,000/- with a complaint. Upon submission of the said complaint, the Branch Manager of the Axis Bank, Goalpara Branch shall initiate the procedure as stipulated in the Grievance Redressal Mechanism mentioned in the SOP dated 02.01.2026 and take steps for bringing the grievances of the petitioner to a logical conclusion. Accordingly, the present writ petition stands disposed of with the following observations and directions: i) The petitioner is granted the liberty to approach the Branch Manager, Axis Bank, Goalpara Branch, wherein the petitioner has bank account with a complaint with regard his grievance. ii) Upon receipt of the complaint, the Branch Manager of the Axis Bank, Goalpara Branch shall initiate the process of the Grievance Redressal Mechanism stipulated in the SOP dated 02.01.2026 so that the petitioner’s grievances can be brought to a logical conclusion.
