This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the applicant who has been arrested in connection with Crime No.150/2025 registered at Police Station Durajpur, District-Surajpur (C.G.), for the offence punishable under Sections 317(4), 318(4), 61(2)(A) of Bhartiya Nyay Sanhita, 2023 and Section 66(D) of the Information Technology Act, 2000. 2. Case of the prosecution, in brief, is that upon receipt of information from the Indian Cyber Crime Coordination Centre (I4C) through the VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2026.01.08 14:21:42 +0530
2 coordination portal, indicating that several victims had lodged online complaints regarding incidents of cyber fraud committed through various bank branches operating at Layer-1, the matter was forwarded to the Office of the Inspector General of Police, SIB/CCTNS/Cyber Crimes, Police Headquarters, Nawa Raipur (Chhattisgarh) for taking appropriate legal action. After conducting a preliminary inquiry into the said online complaints of cyber fraud, the present FIR was registered. 3. Learned counsel for the applicant submits that the applicant has been falsely implicated in this case. He further stated that the applicant is a young student and he had given his Aadhar card to the co-accused to get a job, which was misused by the co-accused to open a bank account in the name of the applicant, thereby committing fraud. He also submits that applicant has no role in crime in question and also he has no criminal antecedent. The applicant is in jail since 05.04.2025 and the conclusion of the trial is likely to take quite long time. Therefore, he prays for releasing the applicant on regular bail. 4. Learned counsel appearing for the State/non-applicant would oppose the bail application and submit that the charge-sheet has been filed in the present case before the competent Court.
He further submits that applicant sold his account to co-accused and fraud of Rs.82,00,000/- has been committed through the account of the applicant. He further submits that the bail application of co-accused bail application has already been rejected by this Court in MCRC No.5792 of 2025 vide order dated 24.07.2025, therefore, applicant is not entitled for grant of bail. 3
5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts and circumstances of the case, submissions made by learned counsel for the parties, allegation levelled against the applicant and considering the fact that the applicant sold his account to the co-accused and fraud of Rs 82,00,000/- has been committed through the applicant's account, and co-accused bail application has already been rejected by this Court in MCRC No.5792 of 2025 vide order dated 24.07.2025, the charge-sheet has been filed before the competent Court, this Court is of the opinion that is not a fit case to enlarge the applicant on regular bail. 7. Accordingly, the bail application of the applicant- Dileshwar Banjare involved in Crime No.150/2025 registered at Police Station Durajpur, District-Surajpur (C.G.), for the offence punishable under Sections 317(4), 318(4), 61(2)(A) of Bhartiya Nyay Sanhita, 2023 and Section 66(D) of the Information Technology Act, 2000, is rejected. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9. Office is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith. Sd/-
