Kausik CRM (M) 728 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Gangajalghati Police Station Case No. 170 of 2022 dated 19.11.2022 under sections 376/506 of the Indian Penal Code. And In the matter of : Lakhindra @ Lakhindar Mandi ……Petitioner. Mr. Prolay Bhattacharya Ms. Tanusree Ghosh Mr. Koushik Roy ……for the Petitioner. Ms. Sukanya Bhattacharya Mr. Md. Ejaj Akhtar ……for the State. Petitioner was arrested on 20th November, 2022 and is in custody since then. According to the petitioner, prosecution has relied upon 21 witnesses in order to prove its case and till date only 5 witnesses have been examined. Victim has already been examined. Learned advocate for the State opposes the prayer for bail and produces the order dated 06.02.2026 passed by the learned Trial Court. Majority of the witnesses are to be examined. However, learned Trial Court has observed that some of the relatives of the victim lady are yet to be examined. 2 In view of the time which has already passed, another 3 months time is granted to complete the evidence of the relatives of the victim lady. Learned Trial Court, after the said period is over, will release the petitioner on bail on such terms and conditions as he deems fit and proper. With the aforesaid observations CRM (M) 728 of 2026 is disposed of. Learned advocate for the petitioner and learned advocate for the State would within 10 days from date communicate this order to the learned Trial Court. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
