Heard learned counsel for the applicant as well as learned A.G.A. for the State. This application under Section 529 BNSS has been filed to direct the court concerned to decide the Complaint No. 667 of 2025 (S.K. Motors Maharajganj Vs. Rehan Motors Kolhui, Maharajganj), under Section 138 of the Negotiable Instruments Act, Police Station Kotwali, District Maharajganj, expeditiously within a stipulated period. Learned counsel for the applicant submits that the said case is pending since 30.1.2025. It is further submitted that as per Section 143 (3) of the N.I. Act it should be disposed of within a period of six months from the date of filing of the complaint but more than one and half years have been passed and complaint has not been decided yet. Considering the facts and circumstances of the present case, the court concerned is directed to make all endeavours to decide the aforesaid case as per Section 143 (3) of the Negotiable Instruments Act as well as Section 309 Cr.P.C. (corresponding Section 346 BNSS), after giving opportunity of hearing to both the parties, without giving any unnecessary adjournments to either parties, if there is no other legal impediment in deciding the aforesaid case.
