Order No.04 Dated-13-05-2026
Heard the parties.
The petitioner has been made accused in connection with Bano (Girda O.P.) P.S. Case No.32 of 2022 corresponding to G.R. No.276 of 2022 (S.T. No.184 of 2022) registered under Sections 302/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner, in furtherance of common intention with the co- accused persons, has committed the murder of Pyari Topno. It is submitted that the allegation against the petitioner is false. It is further submitted that so far as four witnesses have been examined in this case and though the P.W.1 and P.W.2 have not supported the case of the prosecution, P.W.3 is the doctor who conducted the post-mortem examination but the P.W.4 has supported the case of the prosecution. It is next submitted that there is contradiction in his testimony. It is also submitted that the petitioner has been in custody since
12.07.2022. Hence it is submitted that the petitioner be released on bail.
Learned Addl. P.P. appearing for the State vehemently opposes the prayer for bail and submits that keeping in view the serious nature of allegation against the petitioner of committing the murder of Pyari Topno, there is every chance of the petitioner absconding and tampering with the evidence if released on bail. It is, therefore, submitted that the petitioner ought not be released on bail at this stage.
Considering the serious nature of allegation against the petitioner as well as his chance of absconding and tampering with the evidence, this Court is of the considered view that this is not a fit case where the above-named petitioner be released on bail. Accordingly, the prayer for bail of the above-named petitioner is rejected at this stage.
