Mr. Sambuddha Dutta, Mr. Abhishek Chakraborty ....for the State. 1. Matter is heard in presence of the learned advocates representing the petitioner and State respondents. 2. However, private respondents are not represented. 3. Learned advocate representing the petitioner submits that petitioner has right to cultivate the land in question on grant of patta in her favour. 4. However, private respondents are disturbing the petitioner in enjoying the right to cultivate the land in question which prompted the petitioner to file the present writ petition seeking direction upon the concerned police authorities to take steps which would ensure petitioner’s right over the land in question. 5. Learned advocate representing the State respondents has filed a communication dated 2nd April, 2026 of Officer-in-Charge, Sandeshkhali Police Station, Basirhat Police District and same is taken on record. Copy of the said communication dated 2nd April, 2026 is made over to the learned advocate representing the petitioner. 6. It is disclosed in the communication dated 2nd April, 2026 that both the petitioner and private respondents are claiming right over the land in question. 7. On enquiry prosecution being Sandeshkhali Police Station NCR No.74/26 dated 18th February, 2026 under Section 126 of BNSS is submitted to maintain peace at the locale. 8. Having considered the case made out in the writ petition and the contents of the communication it is found that it is a dispute between the petitioner and private respondents over the land in question. 9. Police authority is not the appropriate authority to decide the inter se right of the parties relating to the said land. 10. Leave is granted to the petitioner to approach the appropriate forum asserting her right over the land in question. 11. However, concerned police authorities are directed to maintain peace and tranquility at the locale. 12. The writ petition stands disposed of. 13. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings. (Saugata Bhattacharyya, J.) 2
