JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners are before this Court calling in question proceedings in C.C.No.11419/2021 pending before the VII A.C.M.M Bengaluru, for the offences under Section 498-A of Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act. 2. Heard Sri.Rajesh A, learned counsel appearing for the petitioners, Sri.K.Nageshwarappa, learned HCGP appearing for respondent No.1, Sri.Dilraj Rohit Sequeira, learned counsel appearing for respondent No.2 and have perused the material on record. 3. The parties to the lis were also before the Family Court in M.C.No.6566/2021 and have settled the dispute amongst themselves before the Family Court by terms of Memorandum of Settlement. One of the term of the settlement is, closure of the present proceedings. The said term in the settlement reads as follows: - 4 - HC-KAR NC: 2026:KHC:12124 CRL.P No. 7297 of 2024 “… … … 6. The petitioner has agreed to cooperate to close/quash the C.C.No.11419/2021, arised out of Crime No.9/2021 of Vidyaranyapura Police Station, Bengaluru, under Section 498-A of IPC and Sections 3 & 4 of D.P. Act, filed against the respondent and his family members, which is pending before VII ACMM, Bengaluru, in pursuance of this settlement/agreement. 7. In view of this settlement, the petitioner has agreed to withdraw Crl. Misc. No.128/2021 filed under Section 12 of D.V Act against the respondent herein and the same Is pending before MMTC-III, Bengaluru, without any further prosecution. 8. Both the parties hereby withdraw the allegations made against each other unconditionally, in view of this settlement. 9. Both the parties agree that they shall not interfere in any manner in the life of each other in future, and both parties are free and they are entitled to lead their life independently as per their choice without any objection, interference by either party. III. In view of the aforesaid settlement entered into between the parties, the parties pray that this Hon'ble Court be pleased to dissolve the marriage solemnized between the petitioner and the respondent on 16.12.2017 at Huligamma Devi Devasthana, Munirabad, Koppala Taluk and District and direct to cancel the marriage certificate registered on 16.12.2017 before the Registrar of Marriages, Gadag vide No.GDG-HM463- 2017-18, stored in C.D.No.GDGM22, in terms of the aforesaid agreement...” 4.
