JUSTICE R DEVDAS ORAL ORDER Learned High Court Government Pleader takes notice for both the respondents. 2. The grievance of the petitioner is that although it is not disputed at the hands of the respondent authorities, that 2 acres of land in Sy.No.41 of Kuruvangi Village, Kasaba Hobli, Chikkamagaluru Taluk and District was granted in favour of the petitioner's father, Sri B. Rangaiah, in the year 1956, pursuant to which, a sagulichit was issued and the name of the grantee was entered in the revenue records and the name of the petitioner has been entered in the revenue records pursuant to the death of the petitioner's father, nevertheless, in the - 3 - HC-KAR NC: 2026:KHC:8990 WP No. 4506 of 2026 akarband, the land in possession of the petitioner is shown as 1 acre instead of 2 acres. It is contended that the Deputy Commissioner, Chikkamagaluru District, has passed an order at Annexure-H dated 25.02.2014 in proceedings bearing No.DDLR.RP10/2013-14 directing the Tahsildar to take steps to rectify the mistake, but, no steps have been taken by the Tahsildar in this regard. However, the learned High Court Government Pleader submits that the order passed by the Deputy Commissioner at the instance of the petitioner at Annexure-H is without notice to the neighbouring landowners. 3. Having regard to the contentions raised by the petitioner and on perusing the petition papers, this Court is of the considered opinion that since the name of the petitioner is reflected in the RTC showing 2 acres in favour of the petitioner in old Sy.No.41 and it is found by the Deputy Commissioner in the order at Annexure-H that the land granted to the petitioner's father was assigned a new Sy.No.488, the Tahsildar and the Jurisdictional Assistant Director of Land Records are required to redress the grievance of the petitioner by issuing notice to the neighbouring landowners, hear them, and - 4 - HC-KAR NC: 2026:KHC:8990 WP No. 4506 of 2026 thereafter proceeding to rectify the mistake in the akarband. The entire exercise shall be completed as expeditiously as possible and at any rate within a period of three months from the date of receipt of a copy of this order. Ordered accordingly.
