01. While arguing for a while, learned counsel appearing on behalf of the petitioner made an innocuous submission that the application preferred by the petitioner for transportation of cross-breed Jersey cows for a dairy farm, though duly recommended by the Chief Animal Husbandry Officer, Anantnag vide communication dated 20.03.2026 has not yet been brought to its logical conclusion or considered by the competent authority, i.e., the concerned Deputy Commissioner, despite the fact that the said application was forwarded by the Additional District Magistrate, Anantnag to the Deputy Commissioner, Kathua vide communication dated
23.03.2026. 02. Learned counsel for the petitioner with a view to fortify his claim has placed on record the recommendation of the Chief Animal 115 Suppl-I
Husbandry Officer, Anantnag dated 20.03.2026. It is further submitted that verification has been conducted by Police Station, Mattan through SI Daljeet Singh, wherein it has been reported that the particulars of the petitioner are found to be correct and the petitioner is not involved in any subversive activities and no criminal case is registered against him as per the record of the Police Station. Despite clearcut recommendations by the appropriate authorities i.e., the Chief Animal Husbandry Officer, Anantnag and the S.H.O. Police Station Mattan and further recommendation by the Additional District Magistrate, Anantnag, the matter has not been finally decided by the Deputy Commissioner, Kathua. 03. After arguing for a while, learned counsel for the petitioner submits that he would feel satisfied that if a direction is issued to the Deputy Commissioner, Kathua to accord due consideration to the said application within some reasonable period to which on the asking of the Court, Mr. Mohsin S Qadri, learned Senior AAG waives notice on behalf of the respondents and submits that he is not averse, provided the same is considered strictly in accordance with rules and as per law. 04. With the consent of the learned counsel for the parties and an innocuous prayer being made, the instant petition is taken up for disposal at the threshold. 05.
The writ petition, in the aforesaid backdrop, is disposed of with a direction to the Deputy Commissioner, Kathua to consider the
application preferred by the petitioner which has been forwarded and recommended by the concerned authorities i.e., Chief Animal Husbandry Officer, Anantnag and the S.H.O. Police Station Mattan, within a period of four weeks from the date a copy of this order along with the writ petition and its[ annexures is made available to the said respondents strictly in accordance with the rules and as per law. Needless to say, while according consideration to the petitioner, if the need arises, the petitioner shall be provided an opportunity of being heard and shall also be at liberty to place on record the appropriate documentary proof, if so required, in this regard. 06. The writ petition stands disposed of in the manner indicated above. (WASIM SADIQ NARGAL )
