None for the petitioner. Mr. P.C. Bisht, Additional CSC, for the State. (2) Petitioner is serving as Assistant Teacher in a Government Primary School in District Rudraprayag. By means of this writ petition, she has sought the following reliefs: “i) Issue a writ, order or direction in the nature of mandamus commanding and directing the respondents to grant Child Care Leave (CCL) to the petitioner with full pay w.e.f. 08.02.2023 to 25.05.2023. ii) Issue a writ, order or direction in the nature of mandamus commanding and directing the respondents to forthwith release the salary of the petitioner as and when it became due.” (3) Learned State Counsel has referred to a letter dated 8.2.2023, issued by Deputy Education Officer (Elementary), Agastyamuni, Rudraprayag, which is on record as Annexure-2 to the counter affidavit filed on behalf of respondent no. 2, 3 and 4. By the said letter, petitioner was asked to reapply for Child Care Leave along with necessary documents. (4) Admittedly, petitioner has not reapplied pursuant to the aforesaid communication dated 8.2.2023. Learned State Counsel is right in submitting that since petitioner has sought a writ of mandamus, therefore, writ petition can be disposed of with liberty to the petitioner to approach the competent authority by 2026:UHC:695 making such application along with all supporting documents. (5) Accordingly, writ petition is disposed of granting liberty to petitioner to approach the competent authority by making fresh application for grant of Child Care Leave along with necessary documents. Competition authority shall pass necessary order on petitioner’s application, as per law, within eight weeks from the date of receipt of such application.
