State Legal Services Authority, Kasumpti, Shimla-9 and the matter be listed thereafter. Learned counsel for respondent No.2/complainant, under instructions, submits that the matter has been reconciled between the parties and he has no objection in case the present application is allowed. In view of the submission as well as the judgment passed by the Division Bench in Chune Ram vs. Brikam Chand, 2025:HHC:38122 decided on 13.11.2025 the present petition is allowed and the judgment of conviction and order of sentence passed by Judicial Magistrate First Class, Nahan, District Sirmaur, H.P. in case No. 386 of 2019 dated 21.10.2024 as affirmed by learned Sessions Judge, Sirmaur, District at Nahan in case No. 115 of 2024 dated 05.07.2025 and by this Court in Cr. Revision No. 496 of 2025 decided on 16.09.2025 are ordered to be quashed. It has been submitted that ₹60,000/- have been deposited before learned Judicial Magistrate First Class, Nahan, which are to be disbursed to the complainant in terms of the compromise. Let the amount of ₹60,000/- deposited before the learned Trial Court are ordered to be disbursed to the complainant by remitting the same to his savings bank account on furnishing of the bank account details, if not furnished earlier. The petitioner is stated to be in judicial custody and he is presently lodged in Model Central Jail, Nahan. He is ordered to be released forthwith, if not required in any other case. Release warrants be prepared accordingly and the same be sent to the Superintendent, Model Central Jail, Nahan through FASTER forthwith for necessary compliance.
