Mr. Debottam Das … for the Petitioner 1. This instant revisional application has been filed seeking appropriate directions for expeditious disposal in the Misc. Case No. 436 of 2022 under Section 12 of the Protection of Women from Domestic Violence Act, 2005 pending before the learned Judicial Magistrate, 3rd Court at Durgapur. 2. It is submitted on behalf of the petitioner that the proceeding was initiated on September 27, 2022. Notice was served and by an order dated November 29, 2022, an ex parte ad-interim order was passed by the learned Judicial Magistrate, 3rd Court, Durgapur was initiated. Subsequently, after several adjournments obtained by the respondents, interim order was passed on November 22, 2023 directing payment of maintenance to the petitioner. 3. It is also submitted by the learned advocate appearing for the petitioner and also evident from the copy of the order-sheets annexed with the instant application that since after passing of the interim order, the respondents/opposite parties have obtained 2 several adjournments on one or the other ground. The matter was fixed for ex parte hearing and at such stage, the respondents/opposite parties appeared in the proceeding and sought for setting aside the ex parte order. 4. Learned advocate appearing for the petitioner also submits that the respondents/opposite parties have been irregular in the payment of maintenance amount as directed in the ad-interim order as well as in the interim order passed by the learned Judicial Magistrate, 3rd Court at Durgapur. By order dated November 26, 2025, the proceeding which was fixed for ex parte hearing was again recalled from ex parte subject to payment of cost of Rs. 500/- by the respondents/opposite parties and the case was fixed on February 21, 2026 for recording evidence. 5. As narrated above, it would be appropriate to request the learned Judicial Magistrate, 3rd Court at Durgapur to try and dispose of the Misc. Case No. 436 of 2022 filed under Section 12 of the Protection of Women from Domestic Violence Act, 2005 pending before it as expeditiously as possible without granting any unnecessary adjournments to either of the parties and the recording of evidence in the proceedings may be completed within two months from the next date fixed in the proceeding. 6. With such observations, CRR 846 of 2026 stands disposed of. 7. All parties shall act on the basis of server copy of this order duly downloaded from the official website of this Court. 3 8.
