HON’BLE SHRI JUSTICE BIBHU DATTA GURU
Order on Board 10/02/2026
1. By the present writ petition filed under Article 226 of the Constitution of India, the petitioner is seeking a direction towards the respondent authorities to release the pension and other retiral benefits along with interest.
2. The contention of the petitioner is that initially he was appointed as Forest Guard on 31.12.1983 and in the year 2010, he has been promoted to the post of Deputy Ranger and subsequently to the post of Forest Range Officer in December 2021. Subsequently, on attaining the age of Superannuation he retired from the service on 30.06.2025. According to the petitioner, during the entire service period, he has not earned any adverse remarks and no inquiry has been initiated against him, despite the said fact till date the retiral dues have not been released in favour of the petitioner. For redressing the grievance the petitioner is running from pillar to post, but the same does not fructify even the petitioner made several representation and the same have also not been decided for the reasons best known to the authorities.
3. On the other hand, learned counsel appearing for the State would submit that if the petitioner approached the State authorities by moving fresh representation, the same will be considered and decided in accordance with law and within a stipulated period.
4. Having considered the entire facts and circumstances of the case,
3 particularly, considering the fact that the petitioner is a sexagenarian and retired from service in the month of June 2025, the writ petition is
disposed of with a direction to the petitioner to file a fresh representation before the respondent No.1 within a period of 15 days, and thereafter, the respondent No.1 is directed to consider and decide the same in accordance with law and on its own merits within a further period of 15 days and pass suitable orders to release the retiral dues of the petitioner, including the pension, if there is no departmental enquiry or any recovery is pending against the petitioner. The entire exercise shall be completed within a period of 30 days.
5. Accordingly, with the aforesaid direction, the writ petition is disposed of.
