The present application under Section 528 of the Bharatiya Nagarik Suraksha Sanhita has been filed to quash the entire proceedings of Complaint Case No. 112 of 2025 (Special Case No.246 of 2026, under Sections 65(1), 62, 115(2) of BNS & Section 16/17 of POCSO Act, Police Station Dataganj, District Budaun), as well as cognizance/ summoning order dated 17.1.2026 and the order dated 29.4.2026, passed by Additional Sessions Judge/Special Judge, POCSO Act, Budaun, whereby application to send the case to Juvenile Justice Board has been dismissed, pending in the Court of Additional Sessions Judge/Special Judge, POCSO Act, Budaun. After some arguments, learned counsel for the applicant does not want to press the present application. In view of above, the present application is dismissed as not pressed with liberty to file appropriate application/proceedings before the court of competent jurisdiction.
