Heard Sri Parvesh Kumar Pandey, learned counsel for the petitioner, learned Standing Counsel for respondent nos. 1 to 5 and Sri Pradeep Singh, learned counsel for respondent no. 6. 2. The present petition has been filed seeking following reliefs:- "Issue a writ, order, or direction in the nature of mandamus commanding respondent No. 2/District Magistrate, Bhadohi to take necessary and appropriate steps, in accordance with law, for the removal of illegal encroachments made by respondent nos. 7 to 17, upon the public utility land bearing Arazi No. 341/0.0680; recorded as "Irrigation Department (Nali)"; as per the revenue records of Gram Sabha, Banjari, Tehsil Aurai, District Bhadohi in accordance with law." 3. In pursuance of the direction of this Court, instruction dated 3.10.2026 sent by Sub-Divisional Magistrate, Tehsil-Aurai, District Bhadohi has been placed before this Court, which is taken on record. 4. A perusal of the aforesaid instruction shows that during the inspection by the revenue team of the plot in question, respondent nos. 7, 8, 9, 12, 14 & 15 were found in illegal occupant over it. Proceedings under Section 67 of the U.P. Revenue Code, 2006 have been initiated against the encroachers regarding which Case Nos. T202616670611934, T202616670611951, T202616670611952, T202616670611954 & T202616670611955 have been registered before the Tehsildar, Tehsil Aurai, District Bhadohi, which is pending consideration. 5. In view of the aforesaid, as appropriate proceedings prescribed under the Versus Counsel for Petitioner(s) : Parvesh Kumar Pandey, Sarvesh Kumar Pandey Counsel for Respondent(s) : C.S.C., Pradeep Singh Ramprasad .....Petitioner(s) State Of U.P. And 16 Others .....Respondent(s) law has already been initiated against the encroachers, no further inquiry is required to be conducted by this Court in the present petition. 6. In the aforesaid circumstances, the present petition is disposed of with direction to the Tehsildar, Tehsil Aurai, District Bhadohi to decide the aforesaid pending cases registered before him in accordance with law, after hearing the concerned parties within a period of three months from the date of production of certified copy of this order.
