2. The petitioner herein is assailing the order dated 20.01.2026 (Annexure-D) passed by Respondent No.2, de-recognizing the school under the Provisions of the Karnataka Education Act, 1983.

Learned counsel appearing for the petitioner contended that, the basis for issuance of the impugned memorandum/order dated 20.01.2026 at Annexure-D is based on the order dated 19.01.2026 passed by this Court in W.P.No.17821 of 2018 (Annexure-C). It is also submitted that, while referring to the order-sheet dated 19.01.2026 in the aforementioned writ petition, the reasons assigned in the impugned memorandum/order is not found in the same and the learned counsel for the petitioner sought for allowing the writ petition.
4. Per contra, learned AGA appearing for the respondents sought to justify and defend the impugned
order dated 20.01.2026 at Annexure-D and submitted that, the Petitioner-Institution has violated the provisions

Having taken note of the submissions made by the learned counsel for the parties, I have carefully examined the reasons stated in the impugned memorandum/order dated 20.01.2026 at Annexure-D, wherein certain observations have been made in the impugned order as to the proceedings before this Court on 19.01.2026 in W.P.No..17821 of 2018.
6. Perusal of the order-sheet dated 19.01.2026 at Annexure-C would indicate that there is no such observation made by this Court and therefore, it is a clear case of non-application of mind by the Respondent/ Authorities, while issuing the impugned memorandum/
order at Annexure-D. Therefore, I find force in the submission made by the learned counsel appearing for the petitioner. Accordingly, the I pass the following:

ORDER
i) Writ Petition is allowed.
ii) The impugned order dated 20.01.2026 at
Annexure-D passed by Respondent No.2 is
