Also heard Mr. K K Das, learned Additional Public Prosecutor, Assam. This is an application filed under Section 483 of the BNSS, 2023 whereby the petitioner Md. Raju Ali has prayed for releasing him on bail after he was arrested in connection with Paltanbazar P.S. Case No. 21/2026. The learned Additional Public Prosecutor has insisted on calling for the Case Diary because the Page No.# 2/2 allegations brought against the petitioner covered under Section 3/4/5(1)/7 of the Immoral Traffic (Prevention) Act, 1956. In fact, it was suspected that acts of prostitution were going on in a beauty parlour. From the Police Forwarding Report, it is found that the petitioner was waiting at the beauty parlour to have sexual services. The petitioner was found waiting but not found to be indulging in any sexual act. The petitioner has already completed 10 (ten) days in judicial custody. I have considered the submissions made by the learned counsel for both the sides. Under the given circumstances, the petitioner does not deserve to be detained in custody any longer. Hence, the prayer for bail of the petitioner is allowed. Accordingly, the petitioner, Md. Raju Ali, who is in custody in connection with Paltanbazar P.S. Case No. 21/2026 is allowed to go on bail of Rs.20,000/- with one surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Kamrup (M), Guwahati.
