The instant bail application has been preferred by the petitioner for grant of regular bail for the offences registered under Sections 111(2)(b) of BNS & Sections 17(b), 18(b), 21(b), 25, 27, 28, 29 of Narcotic Drugs and Psychotropic Substances Act, 1985 and cognizance has been taken under Section 111(2)(b) of BNS and u/s. 17(b), 18(b), 21(b), 25, 27, 28, 29 of NDPS Act. 3. Learned counsel for the petitioner submits that earlier the bail application of the petitioner has been rejected by this Court vide order dated 17.03.2026, passed in B.A. No. 1326 of 2026. Learned counsel further submits that co-accused Diwakar Kumar @ Avinash Kumar has been granted bail by a Co-ordinate Bench of this Court vide order dated 09.04.2026 passed in B.A. No. 734 of 2026. He further submits that petitioner is languishing in custody since 18.08.2025; as such, the petitioner may be enlarged on bail. Learned counsel further submits that the petitioner is ready to abide by every condition imposed by this court. 4. Learned A.P.P. for the State opposes the prayer for bail of the petitioner. 5. Having regard to the period of custody of the petitioner coupled with the fact that co-accused has been granted bail by a Co-ordinate Bench of this Court; I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner is directed to be released on bail on 2026:JHHC:15175 2 furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-III-cum-Special Judge (NDPS), Chatra in connection with Pathalgodda P.S. Case No. 33 of 2025 corresponding to NDPS Case No. 31 of 2026. 6. It is made clear that the petitioner shall appear on each and every date before the learned trial court and if any adverse report will come against the petitioner, learned trial court shall be at liberty to cancel the bail of the petitioner.
