This Interlocutory Application has been filed for impleadment of the opposite parties as the earlier incumbent, who were arrayed as Respondents No. 1 and 2 had demitted their Office. Accordingly, this application has been filed seeking impleadment of the Opposite Parties as Respondents No. 3 and 4, who are presently holding the Office as the Secretary to the Government of Assam, Department of School Education and the Director of Secondary Education respectively. Mr. S. M. T. Chistie, learned Standing Counsel appearing for the Secondary Education, who was earlier requested by the Court to assist the Court in the accompanying contempt petition and submits that notice be issued in the Interlocutory Application. However, Mr. S. M. T. Chistie, learned Standing Counsel does not dispute the fact that the opposite parties are presently the incumbent in the Offices of Department of School Education and the Director of Secondary Education. Considering the fact that this is an application seeking impleadment of the present incumbent, namely the Department of School Education and the Page No.# 3/3 Director of Secondary Education, Government of Assam, this Court considers it appropriate to allow the present Interlocutory Application, without issuing notices at this stage. Accordingly the opposite parties, namely, (i) Shri Narayan Konwar, IAS, Secretary to the Government of Assam, Department of School Education, Block ‘C’, Janata Bhawan, Dispur, Guwahati-781006 and (ii) Ms. Mamata Hojai, AES, The Director of Secondary Education, Assam, Kahilipara, Guwahati-781019 are arrayed as Respondents No. 3 and 4 in the Contempt Petition No. 396/2017. Accordingly, this Interlocutory Application stands allowed and disposed of. The petitioner will now file amended cause title within a period of 1 week from today in the present Contempt Petition.
