For the Respondents: Mr. Vishwadeep Sharma, Additional Advocate General. ---------------------------------------------------------------------------- Jyotsna Rewal Dua, Judge This writ petition has been filed for grant of following substantive relief:- “(i) That the respondents may kindly be directed to carry out mutation of the land comprised in New Khasra No.560/222 (Old Khasra No.171/173), measuring 10 Kanal 11 Marla, Situated in Mohal Bhaura, Mauza Jaisinghpur, District Kangra, H.P. in favour of the petitioner in the interest of justice.” 2. Petitioner is with the grievance that despite her repeated representations to the concerned Revenue Authorities, same has not been taken to its logical conclusion. Resultantly, mutation qua the land in question has not been attested in her favour. Yes. 2 required to be looked into and examined by the Competent Authorities. 3. It appears that the petitioner/her predecessors- in-interest have been representing the respondents/ Revenue Authorities for the redressal of their grievance with respect to attestation of mutation but with no constructive response from the concerned quarters. The instructions placed on record by the learned Advocate General from respondent- Forest department are also to the effect that issue primarily pertains to Revenue Authorities though land in question is recorded as “Chargah Darkhtan”. 4. Whether the land in question can be allotted to the petitioner, whether the possession over the land in question was that of the petitioner & whether the petitioner is required to be allotted any other alternative piece of land and other related issues are required to be looked into and examined by the Competent Authority in the first instance. Accordingly, this writ petition is disposed of reserving liberty to the petitioner to file a comprehensive representation to the Deputy Commissioner, Kangra at Dharamshala within four weeks. In case such representation is so the same shall be considered and decided in accordance with law by the Deputy Commissioner, Kangra within six weeks thereafter. 3 The office of learned Advocate General to communicate this order to Deputy Commissioner, Kangra at Dharamshala.
