JUSTICE R DEVDAS ORAL ORDER Learned Additional Government Advocate is directed to takes notice for respondent Nos.1 to 3. Notice to respondent No.4 is not necessary for the following reasons: 2. The learned counsel for the petitioners submits that although there is a judgment and decree passed in favour of the petitioners in O.S.No.103/2010 on the file of learned Civil Judge and J.M.F.C., Tarikere which was confirmed at the hands of this Court, nevertheless respondent No.4 approached the Assistant Commissioner, Tarikere Sub-Division at Annexure-J in proceedings No.RA.231/2017-18 impleading the Tahsildar, Tarikere as the party respondent and not the petitioners. Nevertheless the appeal has been dismissed by the Assistant Commissioner. The Revisional Authority-Deputy Commissioner has also rejected the revision petition filed by respondent No.4 in RP No.63/2019-20 at Annexure K. However, there is an observation in the order passed by the Deputy Commissioner that respondent No.4 may approach the Assistant Director of - 4 - HC-KAR NC: 2026:KHC:13768 WP No. 30481 of 2025 Land Records to redress his grievance. This according to the learned counsel for the petitioners could not have been directed by the Deputy Commissioner. 3. In the considered opinion of this Court, no part of the order passed by the Deputy Commissioner would cause any difficulty to the petitioners, since the petitioners are not parties to the proceedings. Even if such liberty is issued by the Deputy Commissioner to respondent No.4 to approach the jurisdictional Assistant Director of Land Records to redress his grievance, it does not mean that respondent No.4 can approach the Assistant Director of Land Records without impleading the petitioners and no orders can be passed by the Assistant Director of Land Records prejudicing the interest of the petitioners, without notice to the petitioners. With these observations the writ petition stands disposed of.
