This criminal miscellaneous petition has been filed invoking the jurisdiction of this Court under Section 528 of the B.N.S.S., 2023 with the prayer to direct the police for execution of bailable warrant issued vide order dated 13.09.2018, passed in connection with Sadar P.S. Case No. 194 of 2016 corresponding to G.R. Case No. 2735 of 2016 involving the offences punishable under Section 406/420/34 of the Indian Penal Code. 3. It is submitted by the learned counsel for the petitioner that on 13.09.2018 bailable warrant was issued by the learned Judicial Magistrate -1st Class, Ranchi. It is then submitted that the learned court below is taking coercive steps against the accused persons but police is not executing the orders. 4. Perusal of the record reveals that the petitioner never approached the learned Judicial Magistrate with the prayer to ensure execution of the bailable warrant of arrest issued by it. The court of Judicial ( 2026:JHHC:8158 ) Cr.M.P. No.625 of 2026 2 Magistrate is competent to ensure compliance of the orders passed by it. 5. Under such circumstances, this Court is of the considered view that there is no justifiable reason to accede to the prayer of the petitioner in exercise of its power under Section 528 of the B.N.S.S., 2023. 6. The petitioner is free to approach the court of learned Judicial Magistrate –1st Class, Ranchi for ensuring compliance of the orders passed by the court concerned. 7. Accordingly, this criminal miscellaneous petition being without any merit is dismissed. (Anil Kumar Choudhary, J.)
