1. This contempt petition has been filed by the petitioner alleging non-compliance of the order dated 01.12.2004 whereby, the interim order of maintaining status quo passed on 05.04.2004 was confirmed till disposal of the Civil First Appeal No.264/2004.
2. Counsel for the petitioner submits that even though there is a specific order of maintaining status quo however, the respondent tried to take possession of the property in question on
06.07.2026. He has also placed on record certain photographs
[2026:RJ-JP:32510] (2 of 2) [CCP-1327/2026] making allegations against the respondent for damaging the gates and electric connections of the alleged property.
3. As per the submissions made by the counsel for the petitioner, the first appeal pending before the Court arising out of the proceedings of suit for declaration and permanent injunction wherein, the Court has passed an order to the parties to maintain status quo.
4. Counsel for the petitioner states that though no actual possession has been taken by the respondent from the petitioners, however the other party has tried to take possession.
5. Since possession over the property in question has not been disturbed as per the averments made in the contempt petition, this Court finds no ground to initiate contempt proceedings against the respondent.
6. The contempt petition is, accordingly, dismissed.
7. Pending application, if any, also stands disposed of.
