Heard Md. S. Islam, learned counsel for the accused/applicants. Also heard Mr. M.P. Goswami, learned APP for the State.
2. This is an application filed under Section 482 of the BNSS, 2023 praying for grant of pre-arrest bail to the accused/applicants in connection with Kajalgaon P.S. Case No. 135/2026 registered under Sections 329(4)/ 308(1)/ 308(2)/ 356(3)/ 3(5) of the BNS, 2023.
3. An FIR was lodged on 30.07.2026, by the informant who is the owner of a Dhaba alleging that the accused/ applicants along with some 3 girls came to his Dhaba and started behaving suspiciously. After objections raised they went off and later on came into the room of the cook and started touching him and in the meantime, the persons who were accompanying him started taking photographs and videos. Later on, it was alleged that they started demanding money from the Dhaba owner ie., the informant.
4. On receipt of the FIR police registered Kajalgaon P.S. Case No. 135/2026 under the aforementioned sections.
5. Taking into account the entire facts and the submissions made by the
learned counsel appearing for the accused/ applicants as well as the learned
Page No.# 3/3 APP, this Court in not inclined to grant any relief in this case.
6. Accordingly, the instant AB application is dismissed. JUDGE Comparing Assistant
