1) The grievance of Petitioners is that their services were dispensed with and the Contractor was directed to replace them with other persons on the ground that they were involved in Crime No.302 of 2014 of Gajuwaka Police Station, registered for the offences punishable under Sections 379 and 411 of the Indian Penal Code,

The said criminal case ultimately ended in acquittal of the Petitioners in C.C.No.509 of 2016 on the file of the III Additional Chief Metropolitan Magistrate, Gajuwaka. 2) Petitioners were engaged as outsourcing employees through Sri Lalitha Constructions, Visakhapatnam, for carrying out maintenance works in the Respondent Departments. Pursuant to their alleged involvement in the aforesaid crime, Respondents, vide Proceedings dated 04.06.2014, surrendered the services of Petitioners to the Contractor. After their acquittal in the said criminal case, Petitioners submitted representations dated 26.02.2022, 03.01.2023 and 12.03.2023, requesting their re-engagement. It is the contention of Petitioners that they had been continuously working under the Contractor and that their services were subsequently engaged in
4 another establishment/work, but, on account of the aforesaid criminal case, their services were surrendered to the Contractor. 3) In the aforesaid circumstances, Petitioners seek reconsideration of their case for re-engagement through the Contractor and, accordingly, submitted the representations referred to above. 4) The Writ Petition is of the year 2024.
However, no counter- affidavit has been filed by Respondents. 5) Learned Counsel for Petitioners, having regard to the above circumstances, confines the relief sought in the Writ Petition to a direction to Respondents to consider the representations submitted by Petitioners for their re-engagement through the Contractor, subject to availability of vacancies and in accordance with the applicable rules and conditions. 6) Having regard to the submissions made, Respondents are directed to consider the representations dated 26.02.2022, 03.01.2023 and 12.03.2023 submitted by Petitioners and pass appropriate orders thereon, in accordance with law, within a period of eight (08) weeks from the date of receipt of a copy of this Order. 7) It is made clear that this Court has not expressed any opinion on the merits of the case, including the eligibility or entitlement of
5 Petitioners for re-engagement, and it is open to Respondents to consider the same in accordance with law. 8) Accordingly, the Writ Petition is disposed of. No order as to costs. As a sequel, miscellaneous petitions, pending if any, shall stand closed. __________________________ JUSTICE BALAJI MEDAMALLI
