1. Heard Mr. M. Ahmed, learned counsel for the petitioner. Also

This is an application filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for granting pre-arrest bail to the accused/petitioner, namely, Nazar Ali, in connection with Thelamara P.S. Case No. 46/2026, under Sections 65(1)/238 BNS read with Sections 4/17/21 of the POCSO Act, 2012. 3. The allegation as reflected in the FIR is that when the minor daughter of the informant, aged about 14 years had gone to clean the premises of a Madrassa, the accused, one Riyaz Uddin, allegedly lured her and committed physical relation with her. The informant became aware of the incident when she saw a video of the occurrence on 11.07.2026, and that the present petitioner Nazar Ali, along with some other co-accused who had seen the video deleted it and attempted to settle the matter through a village compromise
4. The Case Diary as called for has been received. The statement of the victim before the Magistrate has also been produced, where from it does not appear that any incident of rape had taken place. 5. As far as the present petitioner is concerned, having regard to the allegation specific to the said petitioner, the custodial interrogation of the petitioner is not deemed necessary. Accordingly the prayer for pre- arrest bail is allowed. 6. It is provided that, in the event of his arrest in connection with the aforesaid case, the petitioner named above, shall be released on bail
Page No.# 3/3 of Rs. 50,000/- with two sureties of the like amount to the satisfaction of the Arresting Authority with a condition that the petitioner shall appear before the Investigating Officer within a period of 10(ten) days from today. 7.
