Mr. Prokash Chandra Mondal Mr. Debabrata Mondal Mr. Sayed Hossain ..for the petitioner Mr. Ayan Banerjee ..for the State Affidavit of service filed in Court today is taken on record. The learned advocate appearing for the petitioner submits that the private respondent has been duly served. In spite of service none appears for the private respondent. The petitioner claims to be the owner of a plot of land being Dag No. 190 within Mouza Murail, J.L. No. 216 under Police Station Panskura in the District of Purba Medinipur. The petitioner alleges that the private respondent herein has encroached upon the land belonging to the Irrigation Department of the Government of West Bengal by making construction thereupon. The petitioner alleges that as a result of such illegal construction the ingress and egress of the petitioner from his raiyati property to the main road is being obstructed. 2 The petitioner submitted a representation before various authorities including the Sub-Divisional Officer, Tamluk. The learned advocate appearing for the petitioner submits that no effective steps for removal of encroachment have been taken by the concerned Sub- Divisional Officer excepting forwarding a letter of the learned advocate for the petitioner to the Block Land and Land Reforms Officer. Mr. Banerjee, learned advocate appearing for the State submits that necessary steps in accordance with law shall be taken if any encroachment upon the public land is found. In the light of the submissions made by the learned advocates for the respective parties, WPA 4635 of 2025 stands disposed of by directing the Sub-Divisional Officer, Tamluk being the 8th respondent to consider the representation of the petitioner dated 15th July, 2024 and after causing necessary enquiries and demarcation through the Block Land and Land Reforms Officer, Panskura-I and if upon such demarcation any encroachment upon the public land is found, appropriate proceeding under the relevant statute shall be initiated and the entire exercise shall be completed as expeditiously as possible but positively within a period of twelve weeks from the receipt of a server copy of this order 3 along with a copy of the representation dated 15th July, 2024. There shall be however no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
