2. This is an application under Section 482 of BNSS, 2023 for granting pre- arrest bail to the petitioner namely Md. Sofikul Islam @ Sofiqul Islam apprehending arrest in connection with Alopatichar P.S. Case No. 19/2026 registered Sections 189(2)/ 329(4)/ 296/ 317(2)/ 318(2)/ 304(1)/ 351(2)/ of the BNS, 2023.
3. The allegation as reflected in the FIR is that on 23.04.2026 at about 10.00
Page No.# 2/2 a.m. when no one at home, the alleged accused No. 2 criminally trespassed to the complainant’s house and abused his sister-in-law, accused Nos. 1 and 3 started beating her and outraged her modesty by tearing her cloth. When his grandson tried to rescue her, the accused beat him up and complainant’s son also. And accused Nos. 4, 5 and 6 snatched her gold and silver ornaments. The injured were hospitalized.
4. Case dairy alongwith medical report are received and perused. The medical report indicates lacerated injury on one of the victim’s head and on another victim no fracture is indicated.
5. The statement of the victim itself does not indicate any grievous injury having caused to him as alleged.
6. Having regard to the above, custodial interrogation of the petitioner may not be necessary. The prayer for pre-arrest bail is allowed.
7. Accordingly it is directed that the petitioner named above in the event of his arrest in connection with the aforementioned case, shall be released on bail on furnishing a bail bond of Rs. 50,000/- with 2 sureties of the like amount to the satisfaction of the arresting authority. It is further provided that the petitioner shall appear before the I.O. within 15 days from today and shall cooperate with the investigation.
8. The petition stands allowed.
