Shastri, A.P.P. ------ 05/ 14.05.2026 Heard learned counsel for the petitioner and learned A.P.P for the State. 2. The petitioner is apprehending his arrest in connection with Pakartand P.S. Case No. 02 of 2026, registered for the offence under Section 376 of Indian Penal Code, pending in the court of learned Chief Judicial Magistrate, Simdega. 3. Learned counsel appearing for the petitioner submits that initially the complaint case was filed, which was subsequently converted into the FIR, pursuant to the order of the learned court. He next submits that in the complaint itself, it has been stated that the said occurrence has occurred on 27.01.2017, wherein the complaint case has been filed on 29.10.2025. He further submits that both petitioner and the informant are adults, where the petitioner is aged about 50 years and the informant is also aged about 53 years. He also submits that allegation of establishing relationship on the false pretext of marriage is not correct. He then submits that the petitioner has also signed the petition for registration of the marriage before the Registrar Marriage, Simdega and in view of that the intention of the petitioner is [ 2026:JHHC:14855 ] -2- very much clear. On these grounds, he submits that anticipatory bail may kindly be provided to the petitioner. 4. Learned A.P.P. appearing for the State has opposed the prayer and submits that the allegations are there of establishing physical relationship on the false pretext of marriage. 5. Considering that the petitioner is aged about 50 years and the informant is also aged about 53 years and in the complaint itself, it has been stated that they were in relationship since the year 2017, wherein the complaint case has been filed on 29.10.2025, which was subsequently, converted into the FIR, which prima facie suggests that the relationship was consensual in nature. In the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner. 6. Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Simdega, in connection with Pakartand P.S.
