Heard Mr.Soumitra Kesharwani, learned counsel for the petitioners as well as Mr.Shailendra Sharma, learned Panel Lawyer appearing for respondent No.1/State and Mr.Rahul Mishra, learned counsel appearing for respondent No.2. 2. The petitioners have filed this petition under Section 528 of the BNSS with following prayer:- “1 To allow the instant petition under section 528 of B.N.S.S. 2023 preferred by the petitioners. 2 To quash the FIR no. 0031/2024 registered at P.S.- Mahila-Thana, Ambikapur (Sarguja) dated 02/10/2024 for offence under section 498A of Indian Penal Code, 1860 against the Petitioners. 3 To quash the Charge-sheet bearing no. 04/2025 dated 01.05.2025 emanating from FIR no. 3 0031/2024 registered at P.S.- Mahila-Thana, Ambikapur (Sarguja) dated 02/10/2024 for offence under section 498A of Indian Penal Code, 1860 against the Petitioners. 4 To quash the impugned order dated 02.05.2025 whereby the learned court of Judicial Magistrate First Class Ambikapur, Distt. Sarguja (C.G.) has taken cognizance of the impugned chargesheet in crime no. 0031/24 registered at P.S.- Mahila-Thana, Ambikapur (Sarguja) dated 02/10/2024 for offence under section 498A of IPC and registered the impugned criminal proceedings as Criminal Case/R.Cr.C No. 3567/2025 against the petitioners. 5 To kindly make any other order that may be deemed fit and just in the facts and circumstances of the case including awarding of the cost to the petitioner.” 3. Learned counsel appearing for the parties submit that the dispute between petitioner No.1 and respondent No.2 has been amicably settled subject to fulfillment of terms and conditions of the compromise deed dated 12.01.2026 entered between the parties outside of the Court which finds place along with covering memo dated 24.02.2026, which is taken on record. 4. Upon perusal of the record and after considering the material placed before this Court, including the compromise arrived at between the parties, it is evident that both parties have mutually settled the dispute without any coercion or undue influence. The parties have expressed their willingness to 4 resolve the matter amicably, and the settlement has been voluntarily entered into by them. 5. In view of the aforesaid facts, and in the interest of justice, it is found that there is no further need for continuation of the criminal proceedings. The parties having reconciled, and the dispute having been resolved through mutual consent, this Court is of the opinion that proceedings in Criminal Case/R.Cr.C. No. 3567/2025 before the Judicial Magistrate First Class, Ambikapur against the petitioners are unwarranted and ought to be quashed. 6. Accordingly, criminal proceedings pending before the Judicial Magistrate First Class, Ambikapur, in Criminal Case/R.Cr.C. No. 3567/2025, arising out of Crime No. 31/2024 registered at Police Station Mahila Thana, Ambikapur, for offence under Section 498A of the IPC, charge-sheet bearing No. 04/2025 dated 1.5.2025, and the order taking cognizance dated 2.5.2025 by the Judicial Magistrate First Class, Ambikapur, along with all consequential proceedings, are hereby quashed, subject to fulfillment of terms and conditions of the compromise deed dated 12.01.2026 entered between the parties. 7.
