By way of filing the instant misc. petition, a challenge has been led to the impugned order dated 26.02.2019, passed by the Special Metropolitan Magistrate (N.I. Act, Cases) No.-1, Jaipur Metro, Jaipur wherein the application submitted by the petitioner under Section 45 read with Section 73 of the Evidence Act has been rejected. 2. Aggrieved by the aforesaid, a revision petition was submitted before the Court of Sessions Judge, Jaipur Metropolitan, Jaipur, however, the same was rejected by the order dated 03.04.2019. 3. Before proceeding further to decide the matter on its merits, this Court deems it just and proper to get the status of the trial pending against the petitioner before the Trial Court. The Trial Court has apprised this Court that the accused-petitioner has [2026:RJ-JP:13662] (2 of 2) [CRLMP-3792/2019] already been found guilty for the offence punishable under Section 138 of the Negotiable Instruments Act and he has been sentenced to undergo one year simple imprisonment vide judgment dated 06.05.2022. 4. Hence, under the changed circumstances, the instant criminal misc. petition has become infructuous. Accordingly the same is dismissed as rendered infructuous. 5.
