The present Review Petition has been instituted to review the common order of this Court dated 31.07.2024 passed in W.P.No.9667 of 2024 etc. batch. 2. The review petitioner filed W.P.No.14812 of 2024 challenging the provisional selection list published by the Tamil Nadu Public Service Commission on 19.03.2024 for selection and appointment to the post of Civil judge. The issue https://www.mhc.tn.gov.in/judis REV.APLW No. 77 of 2026 __________ Page4 of 6 regarding reservation as raised in the batch of writ petitions are elaborately considered by this Court and the judgment was delivered on 31.07.2024 which is reported in 2024 MHC 3036. Aggrieved non-selected candidates preferred SLP(C).No.19320 of 2024 and the Hon’ble Supreme Court of India dismissed the SLP on 27.08.2024. Subsequently, the reservation as contemplated under Section 27(f) of the Tamil Nadu Government Conditions of Service Act, 2016 was implemented in tune with the directions issued by this Court in the common order dated 31.07.2024 and a revised selection list was published by the Tamil Nadu Public Service Commission and the selected candidates were appointed as Civil Judges and working for the past about ten months. 3. Learned counsel for the petitioner, Mr.Govardhanan, would mainly contend that the spirit of Section 27 of the Service Conditions Act has not been considered by this Court while implementing the Rule of Reservation. He would argue elaborately by soliciting the attention of this Court with reference to the backlog vacancies to be filled through Backward Class candidates as well as the scope of Section 27(f) of the Service Conditions Act. 4. The matter was heard at a considerable length of time and this Court formed an opinion that the learned counsel for the petitioner made an attempt to re- adjudicate the merits of the case which would fall beyond he realm of the powers of review under Order 47 Rule 1 of C.P.C. 5. Re-adjudication of merits are impermissible in a review proceedings. The scope of review cannot be expanded and the grounds for appeal may not constitute https://www.mhc.tn.gov.in/judis REV.APLW No. 77 of 2026 __________ Page5 of 6 a ground for review. He would contend that certain grounds raised in the writ petition by the review petition has not been considered. However, the said ground would be insufficient to invoke the powers of review. Thus, this Court is not inclined to entertain the review petition. Consequently, the Review Petition stands dismissed. No costs. Consequently, connected miscellaneous petition is closed. (S.M.S.,J.)
