Page No.# 2/3 Also heard Mr. D.P. Goswami, the learned Additional Public Prosecutor appearing for the State of Assam as well as Mr. I. Amin, the learned counsel for the respondent No. 2. 2. This is an application under Section 483 of the BNSS, 2023, whereby the petitioner, namely, Ibrahim Ali has prayed for releasing him on bail in connection with Special (POCSO) Case No. 13(N)/2026, under Section 6 of POCSO Act, pending in the court of the learned Special Judge, POCSO, Nagaon, arising out of Rupahihat Police Station Case No. 373/2025, under Section 4 of POCSO Act, 2012. 3. Today, I have gone through the evidence of the victim as well as the evidence of the Doctor. 4. Mr. Goswami has objected to the bail application on the ground that only the Investigating Officer is to be examined and allowing the bail application of the petitioner might hamper early disposal of the case. 5. I have considered the submissions made by the learned counsel for both sides. 6. The petitioner has already spent about 09 months in judicial custody. 7. On considering the evidence available in the record, this court is of the opinion that the petitioner no longer deserves to be detained in custody. His bail petition is allowed. 8. Accordingly, the petitioner, named above, shall be released on bail in connection with the above noted case, on furnishing bail bond of Rs. 25,000/- (rupees twenty-five thousand), with one surety of the like amount, to the satisfaction of the learned Special Judge (POCSO), Nagaon.
