Mr ___________________________________________________ Sandeep Sharma, Judge(oral): Petitioner herein, who at present is working as TGT in Government High School, Chhawara u/c GMSSS, Bajora, District Kullu, Himachal Pradesh, has approached this Court in the instant proceedings, seeking therein direction to the respondents to consider and decide his representation (Annexure P-4), whereby he has prayed for his transfer from afore station to one of the stations as detailed in the representation on the ground of disability. 2. Petitioner herein, who has otherwise completed his normal tenure of posting at present place of posting, has requested the respondents to transfer him from present place of posting on the ground that on account of location of the school at present place of posting, he, on account of his disability, is finding it difficult to work 1Whether the reporters of the local papers may be allowed to see the judgment? 2 and as such, may be given posting at a school, which is on the road side. 3. Having regard to the nature of prayer and order proposed to be passed, this Court sees no necessity to call for reply on behalf of the respondents, who are otherwise represented by Mr. Rajan Kahol, learned Additional Advocate General. Learned Additional Advocate General fairly states that representation, if not already decided, shall be decided expeditiously. 4. Since it is apparent from the pleadings as well as documents adduced on record at the behest of the petitioner that petitioner is disabled to the extent of 55%, coupled with the fact that transfer policy formulated by the Government of Himachal Pradesh, provides certain concessions to an employee having disability, this Court without going into the merits of the case, deems it fit to dispose of the present petition, with a direction to the respondents to consider and decide the pending representation (Annexure P-4) of the petitioner expeditiously, preferably within a period of four weeks. Ordered accordingly. Ordered accordingly. Needless to say, authority concerned, while doing the needful in terms of instant order, shall afford an opportunity of hearing to the petitioner and pass appropriate order, taking note of transfer policy formulated by the Government of Himachal Pradesh, which enables an employee having disability to seek transfer/ 3 adjustment at a convenient station.
