This is an application under Section 482 of the BNSS, 2023 whereby the petitioner, namely, Rohan Ali is seeking Anticipatory Bail apprehending arrest in connection with an FIR, which is registered as Dibrugarh Police Case No. 213/2026 registered under Sections 126(2)/296/74/75/115(2)/351(3)/3(5) of BNS, 2023 read with Section 25 (1A) of Arms Act. 3. It is the submission of the learned counsel for the petitioner that after the petitioner was granted pre-arrest bail in another case i.e. Dibrugarh Police Station case No. 103/2026, the present case has been lodged against the petitioner only for the purpose of getting him arrested. 4. On the other hand, learned Addl. P.P. submits that the allegation against the petitioner and the other co-accused is that, after obtaining pre-arrest bail, they threatened the informant to withdraw the earlier case. 5. The I.O. has submitted the injury report, which does not indicate any such serious injury. 6. Having regard to the above, the prayer for pre-arrest bail is allowed. The petitioner in the event of his arrest shall be released on bail on furnishing a bail bond of Rs. 50,000/- with two sureties of like amount in connection with the aforesaid case to the satisfaction of the Arresting Authority. It is further provided that the petitioner shall cooperate with the investigation as and when called by Page No.# 3/3 the I.O. 7. Petition stands allowed. 8. Send back the Case Diary.
