The said joint memo reads as hereunder: "The Petitioner and Respondents 1 to 4 submits as follows: 1.The Petitioner undertakes to hand over physical possession of 14.08 guntas of land, more fully described in ANNEXURE- A, in favour of Respondent No.5, subject to forthwith payment of the compensation amount of Rs.9,90,53,805/-, as determined in ANNEXURE-L by the Respondents No.1 to 4, towards acquisition of the said extent in Sy.No.75/1. 2.Furthermore, the Respondents No.1 to 4 undertake to pass an Award under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, within a period of three (3) months from the date of this Joint Memo. - 4 - HC-KAR NC: 2026:KHC:15037 WP No. 6887 of 2026 3.The Petitioner and Respondents agree that, in the event the Petitioner is not satisfied with the Award so passed, the Petitioner shall be at liberty to challenge the same in accordance with the provisions of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. WHEREFORE, the Petitioner and Respondents No.1 to 4 humbly pray that this Hon'ble Court be pleased to dispose the top noted Writ Petition in terms of this Joint Memo, in the interest of justice and equity." 3. The joint memo filed by the petitioner and respondent No.3 is taken on record. 4. Learned counsel for the petitioner submits that the petitioner would adhere to the undertaking at para-1. 5. Taking note of the same, petition is disposed of as not calling for adjudication while observing that the undertaking in the joint memo are to be strictly adhered to by both the parties.
