BEFORE HON'BLE MR. JUSTICE ROBIN PHUKAN ORDER 19.08.2026 Heard Ms. R. Sahin, learned counsel for the petitioner and also heard Mr. P. Borthakur, learned Additional Public Prosecutor, Assam, appearing for the State respondent No.1.
2. This petition under Section 482 of the Code of Criminal Procedure, 1973 is preferred by the petitioner, namely, Akhil Kr. Haloi, for quashing of the FIR of Dispur P.S. Case No.2894/2021, dated 11.08.2021, registered under Section 120(B)/406/420/468 IPC. It is to be noted here that the above noted FIR has been registered on the basis of one complaint lodged by one Dhiraj Borah for Bajaj Finance Ltd.
3. It is to be noted here that vide order dated 08.03.2022, scanned copy of the case diary of Dispur P.S. Case No.2894/2021 was called for. Today, Mr. Borthakur, learned Addl. P.P. submits that after completion of investigation, the I.O. has returned the case as F.R., being F.R. No.3299/2023, dated 15.09.2023, having found no case against the petitioner and at present, no case is pending against him and as such, this petition becomes infructuous and therefore, he has contended to close the same.
4. The learned counsel for the petitioner also submits that since the investigation culminated in submission of F.R. in the case and since no case is pending at present against the petitioner, this petition may be closed.
