This is the first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicants who have been arrested in connection with Crime No. 1/2025 registered at Police Station, Tongpal, District Sukma (C.G.), for the offence punishable under Section 20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985. 2. 2 Yadav, posted at Police Station Tongpal, received information that two persons were travelling to Jagdalpur in an Alto car bearing registration No. UK-06/AC-2585, carrying illegal “ganja”. The Inspector recorded the said information in the Roznamcha and intimated the same to the S.D.O.P., Tongpal, over mobile phone. He was informed that the S.D.O.P. was outside the headquarters. Thereafter, the Inspector was instructed to arrange two independent witnesses. Accordingly, Inspector Surendra Ram Yadav, along with two independent witnesses and police staff, proceeded to the Tongpal Narcotics Checkpoint (Janch Naka) to verify the information. During the checking, an Alto car bearing registration No. UK-06/AC-2585 was intercepted and searched. Upon search, it was found that two persons had concealed 16 packets of
“ganja” inside the seat covers of the car. On enquiry, they disclosed their names as Deepak Singh and Rinku Prasad, residents of Uttarakhand. The accused persons were searched, and 16 packets of “ganja” weighing a total of 44 kilograms and 700 grams were recovered. 3. The contraband articles were seized, and the accused persons were arrested. Consequently, Police Station Tongpal registered Crime No. 01/2025 against the accused persons for the offence punishable under Section 20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985. 4.
None appears nor is any representation made on behalf of the applicants to press this application when the case is called out. 5. It transpires from the record that the applicants are in jail since
11.01.2025. Hence, the Court proceeds to consider and hear the bail application of the applicants with the assistance of the State counsel. 6. Ms. Smriti Shrivastava, learned Panel Lawyer appearing for the
3 State/non-applicant, opposed the bail application and submitted that although the case diary of the present case is not available, a quantity of contraband article, i.e., 44.700 kgs of ganja, was recovered from the joint possession of the present applicants, which is much above the commercial quantity. As such, the applicants are not entitled to be released on bail. 7. I have heard learned counsel appearing for the parties and perused the case diary. 8. From perusal of the case diary, it transpires that the article which has been seized from the joint possession of the present applicants is much above the commercial quantity and it cannot be a case of false implication. 9. Accordingly, the bail application of the applicants - Deepak Singh & Rinku Prasad filed under Section 483 of the BNSS, involved in Crime No. 1/2025 registered at Police Station, Tongpal, District Sukma (C.G.), for the offence punishable under Section 20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985, is rejected. 10. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 11.
