Public Prosecutor has submitted that the case has culminated in a charge sheet being filed in CS No. 24/2026 dated 23.05.2026. Mr. M. Biswas, learned counsel for the petitioner, has fairly submitted that the petitioner would approach the learned Trial Court, praying for appropriate bail, and the present petition may be disposed of by granting liberty to the petitioner to approach the learned Trial Court. Mr. M. Biswas, learned counsel for the petitioner, has submitted that the notice under Section 36 of the BNSS 2023 does not contain the signature of any witness and though it has been recorded that it has been sent through e-mail, the details are not reflected. The learned counsel has also made reference to the absence of a notice under Section 48 of the BNSS. However, since this Court is inclined to grant liberty to the petitioner to approach the appropriate Trial Court praying for grant of regular bail, the issues raised by the learned counsel for the petitioner are not decided for today and are left open for the Trial Court to take note.
